Welcome to Woodpecker Project. These Terms and Conditions ("Terms") govern your access to and use of our website www.woodpeckerproject.com.au (the "Site"), including any purchases made through the Site or in-store. By using the Site or placing an order with us, you agree to these Terms. Please read them carefully.
1. Delivery & Pickups
- Measurements: Customers are responsible for ensuring that all items will fit in their intended spaces. We are not responsible for items that do not fit due to improper measurements.
- Identity Verification: We may require proof of identity, such as a driver’s license or the credit card used for the transaction, prior to releasing goods.
- Delivery Times: Quoted delivery times are estimates only. We are not liable for delays beyond our control.

Rescheduling/Cancellation:
- To cancel an order, notify us promptly. A 25% cancellation fee will apply to cover production and administrative costs.
- Orders that have already shipped cannot be cancelled.
- Rescheduling delivery within two business days of the scheduled date may incur additional charges.
- Access: Customers must ensure reasonable access for delivery. If access is unavailable or if no authorized individual is present at the agreed time, additional delivery charges may apply. Deliveries involving stairs or extra handling may incur additional charges.
- Floor Protection: Customers are responsible for protecting floors and internal surfaces prior to delivery. We are not liable for any damage caused during delivery.
- Packaging Disposal: We offer packaging disposal services for an additional fee. Otherwise, customers are responsible for disposing of packaging materials.
- Inspection: Customers should inspect goods upon receipt. Any damage must be reported immediately and noted on our delivery/pickup documentation. Once goods are accepted, we are not responsible for subsequent damage, including during loading or assembly.
2. Payments

In-Store Transactions:
- Deposits/Payments: We accept cash, credit cards, Eftpos, and Zip card.
- Final Payment: Full payment is required prior to delivery or pickup. Accepted methods include cash, credit cards, Eftpos, and Zip card. Bank transfers or direct deposits must clear before delivery or pickup. Personal cheques are not accepted for final payment.
- Release of Goods: Goods will only be released once full payment has been completed.
- Payment Methods: For online orders, we accept credit cards, PayPal, and Zippay. Full payment is required at the time of purchase.
- Online Transactions: Full payment, including delivery and additional charges, is required at purchase. For security purposes, photo identification and the credit card used may be required upon delivery or pickup.
3. Refund Policy
- Consumer Guarantees: Our goods come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure. Proof of purchase is required.
- Change of Mind: We do not offer refunds or exchanges for change of mind or circumstances.

Refund Methods:
- Payments made via credit card or Eftpos will be refunded via bank transfer.
- Payments made over the phone may require additional verification for security purposes.
4. Warranties
- Structural Warranty: We offer a 12-month structural warranty on all our picnic tables and outdoor furniture. This warranty covers defects in structural integrity due to manufacturing faults.

What is Covered:
- Defects in construction that impair the product’s strength and functionality.

What is Not Covered:
- Natural timber imperfections such as cracks and knots.
- Changes in timber appearance due to environmental conditions.
- Damage resulting from improper maintenance, neglect, or misuse.
- Wear and tear from exposure to the elements.
5. Storage Fees
If a customer does not pick up or arrange delivery within one week following completion or approval for delivery, a storage fee of $100 per item per week will apply. This fee covers the cost of storing the furniture in our workshop until it is collected or delivered.
6. Product Disclaimer: Appearance Variations
While we strive to represent our products as accurately as possible, the exact appearance of the product may vary slightly from what is displayed on our website. Differences in lighting, photography, and digital screens may cause slight variations in color, texture, and grain. As timber is a natural material, each piece will have its own unique characteristics, and no two products will be identical.
7. Privacy Policy
We value your privacy. Personal information collected is used solely to fulfill your order and improve our services. We do not share your information without consent. For more details, please refer to our Privacy Policy.
8. Limitation of Liability
To the fullest extent permitted by law, Woodpecker Project shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of our products or services. Our total liability to you for any damages arising from or related to these Terms, whether in contract or tort, shall not exceed the total amount paid by you to us.
9. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Victoria, Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Victoria.
10. Changes to Terms and Conditions
We reserve the right to modify these Terms at any time. Any changes will be posted on this page with a revised "Last updated" date. Your continued use of our Site or services following the posting of changes constitutes your acceptance of such changes.
